This privacy policy, together with Gecko’s Terms of Use applies as between you, the User of this Website and Gecko the owner and provider of this Website. This policy applies to Gecko’s use of any and all Data collected by Gecko or provided by Users in relation to their use of the Website and any Services or Systems. Please read the following carefully to understand Gecko’s views and practices regarding Users personal data and how it will be treated. For the purpose of the Data Protection Act 1998 (the “Act”), the Data Controller is Gecko.

means collectively all information that Users submit to the Website. This includes, but is not limited to information submitted using any of Geckos Services or Systems;

means collectively any online facilities, tools, services or information that Gecko makes available through the Website either now or in the future;

means any third party that accesses the Website and is not employed by Gecko and acting in the course of their employment; and

“Website”

2. Data Collected

Without limitation, Gecko may collect and process the following Data:

2.1 Information Gecko collects about Users. With regard to each visit of every User to the Website, Gecko may automatically collect the following information:

2.1.1 Internet Protocol (IP) address, web browser type and version, time zone setting, operating system and platform; and

2.1.2 a list of Uniform Resource Locators (URLs) starting with a referring site, Users’ activity on this Website, and the site Users exit to.

2.2 Information Users submit to Gecko: With regard to each visit of every User to the Website, Gecko may collect the following information that is submitted by the User by completing forms on the Website, any correspondence with Gecko or otherwise:

2.2.1 name;

2.2.2 date of birth;

2.2.3 gender;

2.2.4 job title;

2.2.5 profession;

2.2.6 contact information such as email addresses and telephone numbers;

2.2.7 demographic information such as post code, preferences and interests;

2.2.8 Cookie information (see Clause 11 below); or

2.2.9 any other information provided to Gecko by the User completing any forms on the Website or otherwise utilising the Services or Systems.

3. Our Use of Data

3.1 Any Data Users submit will be retained by Gecko for as long as the User uses the Services and Systems provided on the Website. Data that Users may submit through any communications System that Gecko may provide or by completing any forms on the Website may be retained for a longer period of up to 6 months.

3.2 All Data is stored securely in accordance with the principles of the Data Protection Act 1998. For more details on security, see Clause 10 below.

3.3 Any or all of the above Data may be required by Gecko from time to time in order to provide Users with the best possible service and experience when using the Website.

3.4.2 as part of Gecko’s efforts to keep the Website safe and secure;

3.4.3 to improve Gecko’s products / Services; and

3.4.4  to ensure that Content from the Website is presented in the most effective manner for Users and for their computer or other internet browsing device.

3.5 Specifically, Data submitted by the User and collected in accordance with clause 2.2 above may be used by Gecko for the following reasons:

3.5.1 to provide Users with information about other goods and services Gecko offer that are similar to those that you have already enquired about or that Gecko feel may interest any User;

3.5.3 to notify Users about changes to our Service or System; and

3.5.4 to ensure that Content from the Website is presented in the most effective manner for you Users and for their computer or other internet browsing device.

4. Disclosure of Users’ Information

4.1 Gecko may disclose Users’ Data to third parties:

4.1.1 in the event that Gecko sells or buys any business or assets, in which case Gecko may disclose Users Data to the prospective seller or buyer of such business or assets; or

4.1.2 if Gecko or substantially all of its assets are acquired by a third party, in which case Data held about its Users will be one of the transferred assets; or

4.1.3 if Gecko are under a duty to disclose or share a User’s Data in order to comply with any legal obligation, or in order to enforce or apply Gecko’s Terms of Use or to protect rights, property or safety of Gecko, its Users and others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

5. Where We Store Users’ Data

5.1 The Data that Gecko collects from Users may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA who work for Gecko or for one of Gecko’s suppliers. Such staff may be engaged in, among other things the provision of support services. By submitting Data, Users agree to this transfer, storing or processing. Gecko will take all steps reasonably necessary to ensure that Users’ Data is treated securely and in accordance with this privacy policy.

Unfortunately, the transmission of information via the internet is not completely secure. Although Gecko will do its best to protect Users Data, Gecko cannot guarantee the security of Users’ Data transmitted to the Website; any transmission is at the User’s own risk. Once Gecko has received Users’ information, it will use strict procedures and security features to try to prevent unauthorised access.

6. Third Party Websites and Services

Gecko may, from time to time, employ the services of other parties for dealing with matters that may include, but are not limited to search engine facilities, advertising and marketing. The providers of such services do not have access to certain Data provided by Users of this Website. Any use for other purposes is strictly prohibited. Furthermore, any Data that is processed by third parties must be processed within the terms of this policy and in accordance with the Act.

7. Controlling Access to your Data

7.1 Wherever Users are required to submit Data, Users will be given options to restrict Gecko’s use of that Data. This may include the following:

7.1.1 use of Data for direct marketing purposes; or

7.1.2 sharing of Data with third parties.

8. Your Right to Withhold Information

8.1 Users may access certain areas of the Website without providing any Data at all. However, to use all Services and Systems available on the Website Users may be required to submit Data.

8.2 Users’ may restrict your internet browser’s use of Cookies however this may prevent Users’ from using the full range of Services available on the Website. For more information see Clause 11 below.

9. Accessing your own Data

The Act gives Users the right to access information held about them. Each User’s right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of £10 to meet Gecko’s costs in providing the User with details of the information Gecko holds about the User.

10. Security

10.1 Data security is of great importance to Gecko and to protect Users’ Data Gecko has put in place suitable physical, electronic and managerial procedures to safeguard and secure Data collected online.

10.2 Gecko complies with and has been certified for internal security standard ISO/IEC 27001: 2005 (Information Security Management Systems: Requirements).

11. Cookies

11.1 Gecko may set and access Cookies on a Users computer. All Cookies used by the Website are used in accordance with the provisions of the Privacy and Electronic Communications (EC Directive) Regulations 2003 as amended by the Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011.
